ABJ SALES LLC Auction Terms and Conditions

Buyer's Premium: A 10% online buyer's premium will be added to all purchases.

Sales Tax: Applicable Wisconsin sales tax will be charged on all taxable items, including the buyer's premium, unless a valid sales tax exemption certificate is provided. According to Wisconsin Department of Revenue Publication 217, buyer's fees on taxable sales are subject to sales tax. 

Payment Methods: We accept cash, verified checks (accompanied by a bank letter of guarantee for buyers unknown to ABJ SALES LLC), wire transfers, certified checks, and MasterCard, Visa, or Discover credit cards (subject to a 4% convenience fee). The maximum allowable charge on credit cards is $2,000 unless pre-approved. Credit cards are not accepted for titled vehicles.

Payment Terms: All items are sold "AS IS, WHERE IS." "As is" means that the item is offered in its current condition with all faults, whether visible or not, and without any warranties. The term "Where is" specifies that the item must be collected from its current location, and this applies especially to off-site listings. By registering for this auction and/or placing a bid, you acknowledge that you have read and accepted these terms and conditions, including the understanding that all sales are final with no returns or refunds issued for any reason.

Should the buyer fail to contact ABJ SALES LLC within 24 hours of the auction's conclusion, the credit card on file will be charged. Non-payment in full for an item will lead to the buyer being blacklisted from future ABJ SALES LLC auctions and may result in being reported to other auction companies as a non-paying bidder.

Item Pickup: For onsite auctions not located at the ABJ SALES LLC Auction Facility, all items must be picked up during the designated pickup times unless prior arrangements have been made. Items not picked up during these times will be considered abandoned and become the property of the auction company or seller. The buyer remains responsible for full payment; no refunds will be given. Pickup is always on the Monday and Tuesday following the auction. After those designated days, pickup is available by appointment only.

Shipping: Shipping is not available for all auctions. If shipping is not specified as available, please check with the auction house prior to bidding. Typical shipping charges are $10 for the first lot and $2 for each additional lot, plus shipping expenses. Large orders may incur a $10 per box fee. All shipping and insurance expenses are the buyer's responsibility. Certain items are ineligible for shipping, including animal mounts, items that have contained fuel (e.g., lanterns, chainsaws, small engines), large or bulky items, items over 40 lbs., gunpowder, or very fragile items. Items must be picked up within the scheduled pickup time. Items requiring transport back to the ABJ SALES LLC Auction Facility are subject to a $20 hauling fee. Storage fees of $20 per day will apply after five days from the auction's close. Items not picked up within 15 days are considered abandoned and become the property of ABJ SALES LLC. No refunds will be given; the buyer remains responsible for all storage fees.

Auction Closing: Lots will start closing on Sunday, March 9th, at  7pm, with each lot closing every 20 seconds. This is a soft close auction; if a bid is placed on a lot within the last minute before closing, bidding is extended by an additional minute.

Inspection: Buyers are encouraged to inspect items prior to bidding during the designated inspection day. ABJ SALES LLC may describe merchandise in advertising or online but makes no representations or warranties. All items are sold "AS IS," with no implied warranties of merchantability or fitness for a particular purpose. The bidder is the sole judge of value and condition. Bidders who do not attend an inspection or bid remotely acknowledge that they may not be able to inspect an item as thoroughly as in person. It is the bidder's responsibility to determine condition, age, genuineness, value, or any other determinative factor. Questions from buyers prior to bidding are encouraged.

Bidding and Disputes: Auction company employees and/or the auction company may bid on auction items. In the event of a dispute between ABJ SALES LLC and a bidder, the bidder waives any right to a trial or hearing in a court of law and agrees to settle the dispute through arbitration in Jackson County, Wisconsin. All arbitration fees will be split equally between both parties. The bidder further agrees not to initiate a chargeback on their credit card under any circumstances.

Online Bidding Platform: ABJ SALES LLC utilizes BID WRANGLER online bidding services. Bidders acknowledge and understand that this service may experience technical issues before or during the auction. Under no circumstances shall the bidder have any claim against ABJ SALES LLC, the seller, or any other party if internet service fails to function correctly. ABJ SALES LLC reserves the right to pause, delay, or restart bidding at any time and will not be responsible for any missed bids from any source. ABJ SALES LLC also reserves the right to withdraw or re-catalog any item in this auction.

Advertising Compliance: In accordance with Wisconsin regulations, all auction advertising must include the name and registration number of the auctioneer conducting the auction, a statement that the auctioneer is a "registered Wisconsin auctioneer," and the name of any auction company managing the auction. The advertising must state the terms and conditions under which the auctioneer will accept payment by buyers and the percentage of any buyer's fee or surcharge imposed on the buyer.

By participating in this auction, bidders agree to waive their right to a trial or hearing in a court of law and consent to settle disputes exclusively through arbitration. All arbitration fees will be equally divided between the parties involved. Furthermore, bidders agree not to initiate any chargebacks on their credit cards under any circumstances.

Additionally, ABJ SALES LLC reserves the right to withdraw or re-catalog any item in this auction.

Technical Issues and Internet Glitches

Disclaimer of Liability for Technical Interruptions: ABJ Sales LLC shall not be held liable for any technical issues, including internet glitches, hardware malfunctions, or software disturbances that may affect the conduct, operation, or accessibility of online auctions. ABJ Sales LLC commits to providing a reliable auction experience, however, the possibility of occasional disruptions exists due to factors beyond our control.

Bid Retraction and Cancellation: ABJ Sales LLC reserves the right to retract bids, cancel sales, or reschedule auctions in the event of significant technical disruptions. These actions will be taken at our discretion to ensure the integrity of the auction process.

Notification of Technical Issues: Participants are advised to notify ABJ Sales LLC promptly of any technical difficulties encountered during the bidding process by contacting our technical support team at the provided contact information.

Limitation of Liability: ABJ Sales LLC will not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from the use of or inability to use the online auction platform.

Governing Law: This agreement and any disputes arising under it shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law principles. Legal actions or proceedings between ABJ Sales LLC and participants concerning this agreement shall be brought exclusively in a federal or state court located in Wisconsin.

Statutory Compliance: ABJ Sales LLC conducts all auction activities in compliance with applicable laws, including:

• The Wisconsin Consumer Act (Wis. Stat. § 421-429), which governs consumer transactions.
• The regulations under the Wisconsin Administrative Code that pertain to auctions.
• Applicable sections of the Wisconsin Statutes that regulate electronic communications and transactions.
